In 2021, the FAA further refined Part 107 by codifying night operations and operations over people rules. Remote ID enforcement arrived by 2024. And now, in 2026, the FAA's proposed Part 108 and Part 146 regulations are expected to be finalized and will fundamentally reshape how drone pilots operate in U.S. airspace.
Consequences of Violating FAA Drone Rules
Ignorance of the rules is not a legal defense ? and the FAA's enforcement posture has hardened significantly. The FAA fined and suspended or revoked the licenses of multiple drone operators in 2025 for unsafe and unauthorized operations, including flights near major sporting events, emergency response activities, and in restricted airspace.
In 2026, the FAA updated its enforcement policy to require legal action when drone operations endanger the public, violate airspace restrictions, or are conducted in furtherance of another crime. How Rules Differ for Recreational vs. Commercial Pilots
This is one of the most misunderstood aspects of drone law. Many people assume that a recreational flight simply means not flying for a business or being compensated ? it is not correct to assume this is the single determining factor. Compensation, or the lack of it, is not what determines if a flight was recreational or not.
If you want to fly a drone for purely recreational purposes, there is a limited statutory exception ("carve out") that provides a basic set of requirements, known as the Exception for Limited Recreational Operations of Unmanned Aircraft (USC 44809). The rule for operating unmanned aircraft systems or drones under 55.0 pounds in the National Airspace System is 14 CFR Part 107, the Small UAS Rule, which enables certificated remote pilots to fly for work or business. FAA Drone Registration Requirements

However, the moment a sub-250g drone is used commercially, if the drone is used for business ? How to Register on the FAA DroneZone Portal
Registration is completed through the FAA's DroneZone portal and must be renewed every three years. Registration costs $5 and is valid for 3 years. You'll need a credit or debit card and the make and model of your drone handy in order to register. Commercial pilots should create an account and register their drone at FAADroneZone, and select "Fly sUAS under Part 107."
Where to Display Your Registration Number

The TRUST Test: What It Is and How to Pass It
The Recreational UAS Safety Test ? known as TRUST ? is a mandatory, free, online safety course for all recreational flyers. You are required by law to take TRUST and carry proof when flying. Good news: TRUST is free and online. Recreational flyers are required to complete The Recreational UAS Safety Test (TRUST) and carry proof of completion while operating.
TRUST is administered by FAA-approved test administrators. The test is not a graded exam ? it walks you through fundamental safety concepts with immediate feedback on each question. You can retake missed questions instantly, and once completed, you receive a certificate you can display on your phone. There is no excuse not to take it: it takes approximately 30 minutes and costs nothing.
Altitude Limits for Recreational Pilots
Fly at or below 400 feet in Class G (uncontrolled) airspace. This 400-foot ceiling is one of the foundational drone FAA rules that separates drone traffic from manned aircraft. The altitude limit is 400 feet AGL, and going higher requires a Part 107 waiver.
Flying Near Airports and Controlled Airspace as a Hobbyist

Part 107 Certification: Eligibility and Exam Overview
In order to fly your drone under the FAA's Small UAS Rule (Part 107), you must obtain a Remote Pilot Certificate from the FAA. This certificate demonstrates that you understand the regulations, operating requirements, and procedures for safely flying drones.
To qualify: applicants must be at least 16 years old, be able to read, speak, write, and understand English, and be physically and mentally capable of operating a drone safely.
